Tianjin is actively exploring innovative approaches to ecological and environmental law enforcement: continuously optimizing enforcement methods and comprehensively enhancing enforcement effectiveness.
To effectively implement the requirements of the Ministry of Ecology and Environment’s “Guiding Opinions on Optimizing Ecological and Environmental Protection Enforcement Methods and Enhancing Enforcement Efficiency,” Tianjin has, based on its actual work conditions, further refined and broken down the 18 key tasks proposed by the Ministry, and has formulated and issued the “Implementation Plan for Optimizing Ecological and Environmental Protection Enforcement Methods and Enhancing Enforcement Efficiency in Tianjin” (hereinafter referred to as the “Plan”). At the heart of optimizing enforcement methods lies innovation. In this “Plan,” Tianjin is actively exploring new ideas and initiatives for enforcement work, identifying new directions and requirements, and striving to open up a new chapter in ecological and environmental enforcement and achieve a comprehensive enhancement of enforcement efficiency.
New approaches for efficiently coordinating law enforcement resources.
The “Plan” stipulates that the city’s ecological and environmental departments, in accordance with their law enforcement duties, shall scientifically coordinate this year’s routine supervision, special campaigns, and unscheduled enforcement tasks, and develop an annual on-site inspection plan. They should continue to incorporate the special campaigns and positive lists for enforcement activities carried out in 2021 into the “double-random, one-public” regulatory model, thereby achieving “one-time enforcement, comprehensive investigation.” A normalized management mechanism for a positive list of enforcement activities tailored to Tianjin’s characteristics should be established, clearly defining the scope of inclusion and management measures. A differentiated, categorized regulatory approach should be implemented: law-abiding enterprises will not be disturbed unnecessarily, while enterprises found in violation will face strict and unwavering enforcement, thus helping to foster a favorable business environment.
New initiatives to deepen regional law enforcement cooperation.
The “Plan” clearly states that we will continue to rely on the Beijing-Tianjin-Hebei enforcement coordination mechanism, persistently carrying out joint law enforcement efforts across the three regions. Special emphasis will be placed on the autumn and winter periods—times when severe pollution episodes are most likely to occur—through mutual cooperation and coordinated enforcement measures aimed at rigorously cracking down on all types of environmental violations and comprehensively safeguarding air quality. For the first time, a mechanism has been launched for exchanging and training cadres between ecological and environmental enforcement agencies at both the municipal and district levels, enabling the coordinated mobilization of enforcement resources throughout the city. Through mutual learning, mutual assistance, and mutual promotion, this initiative will comprehensively enhance the professional competence of enforcement personnel. Furthermore, we will strengthen collaboration and coordination among enforcement and monitoring agencies, as well as between ecological and environmental authorities and regulatory bodies in other sectors, reinforcing the linkage between administrative and criminal enforcement mechanisms to provide robust support for deepening and winning the battle against pollution.
New direction: vigorously expand non-site supervision.
The “Plan” specifies that by the end of December 2021, the city must establish standardized procedures for non-site-based supervision and adopt non-site-based supervision as the primary means of routine law enforcement. On the one hand, pilot installations of video surveillance will be carried out at selected key pollution-discharging entities listed on the positive enforcement roster, further exploring IoT-based supervision methods such as video monitoring and environmental protection-related electricity and energy consumption monitoring. At the same time, we will actively leverage technological tools—including drones, unmanned boats, mobile monitoring vehicles, and satellite remote sensing—to enhance the precision of law enforcement. On the other hand, we will explore the use of third-party agencies to assist in law enforcement, with a particular focus on their involvement in verifying compliance with discharge permits and the operational status of pollution-control facilities, thereby providing technical support for efficiently detecting and addressing ecological and environmental violations.
New requirements to continuously standardize law enforcement procedures.
The “Plan” requires that the city’s ecological and environmental departments strictly implement the system of publicizing administrative law enforcement and the system of recording the entire enforcement process, standardize the exercise of discretionary powers in administrative penalties, and continuously enhance the standardization of enforcement practices. Taking the intensive training campaign for ecological and environmental protection law enforcement as an opportunity, we must continue to hone the professional competence of our dedicated environmental protection team, striving to elevate our city’s ecological and environmental enforcement work to a new level. Furthermore, by using the mutual review of enforcement case files across the city as a means, we must effectively improve the quality of administrative penalty case files in our city’s ecological and environmental protection field.
Optimizing law enforcement methods and enhancing enforcement effectiveness are essential steps in thoroughly winning the battle against pollution, as well as powerful measures for achieving precise, scientific, law-based, and systematic pollution control. The ecological and environmental departments at all levels in Tianjin will rigorously implement the requirements of the "Plan," ensuring that all initiatives take root and flourish in Tianjin, comprehensively enhance the effectiveness of ecological and environmental law enforcement, and promote continuous improvement in ecological and environmental quality.
